Waiver of Liability and Hold Harmless Agreement
In consideration of participating in Wing Chun Kung Fu (Martial Arts) training, sparring and/or competition, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Wing Chun Kung Fu Close Range Combat LLC, their principals, officers, servants, agents, and employees (hereinafter referred to as RELEASEE) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEE, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted or in transportation to and from said premises.
To the best of my knowledge, I can fully participate in this activity; I am not aware of any disease, injury and or condition that would impair my performance or physical and mental well-being during training or competition. I am fully aware of common risks and hazards connected with full contact martial arts training including, but not limited to, the following injuries or permanent disability: bruises, scratches, bloody lips and noses, torn ligaments, broken bones, eye pokes, damaged teeth, spinal injury, dislocation of joints, contact dermatitis and other contact related skin conditions, and I hereby elect to voluntarily participate in said activity, and to enter the above-named premises and engage in such activity knowing that the activity may be hazardous to me and my property. In addition, I recognize and understand that there may be other risks that are not known to me or to others or not reasonably foreseeable at this time. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEE or otherwise.
I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASEE from any loss, liability, damage or costs, including court costs and attorney’s fees, that may be incurred due to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEE or otherwise.
It is my expressed intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse (if any), if I am alive, and my heirs, assigns and personal representatives, if I am not alive, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above named RELEASEE.
I further agree to become familiar with the rules and regulations of the school and program concerning student conduct and not to violate said rules or any directive or instruction made by the person or persons in charge of said activity and that I will further assume the complete risk of any activity done in violation of any rule or directive or instruction.
This Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Maryland.
Arbitration Clause
I understand and agree that any dispute or claim arising out of or in connection with my participation in martial arts classes and training activities associated with Wing Chun Kung Fu - Close Range Combat Martial Arts shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator appointed in accordance with the rules of the American Arbitration Association. Any decision rendered by the arbitrator shall be final and binding on all parties involved, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Acknowledgment
IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability, Hold Harmless Agreement, and Arbitration Clause, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreement, have been made; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.
Photo/Video Release
On occasion, Wing Chun Kung Fu - Close Range Combat Martial Arts and its agents and employees may use literature, photos, and video to promote itself to the general public. I understand that I will not receive compensation in any form from the use of my photograph or my photographic likeness and recorded voice.
I hereby consent to the use of my name, photograph, photographic likeness, recorded voice and/or image in video that may appear in any publications, promotional posters, flyers, brochures, printed and electronic ads or electronic media, in addition to social media or website.
